I find it slightly weird that during a fight you can't quaff a vial (Which involves drinking) but yet you can smoke a leaf.
How the hell are you going to smoke some leaves while in a intense round of fighting better then drinking a quick vial?
I play my fair share of melee's and I was having a laugh about this. If I ever was dispelled I easily smoked my leaves or ate my pills right away.
As much as I love it I think we should make the same guidelines for black leaves as we do for vials.
In that point how the hell a snail kicks dirt into my eyes, how the hell the squirrel trips me?I agree that there are a lot of funny elements in the game.If we look everything in the game like that and compare it with the reality, it will simply loose it's balance.
if you can't work and smoke at the same time, you shouldn't be smoking, thats what my dad always told me 
Just take your vials to the vendor who gives you sparkling pills for 1000 gold. Problem solved.
Oh, and by the way, if you're not TANKING (IE, the person whose being aimed at by the opposing party) you can quaff a vial in battle while fighting.
well, you can quaff if you're in battle, regardless of position, just if you are tanking you'll likely spill 2-3 potions before you succeed. Like Jibber said, if you're not tanking, you stand better chances of not spilling it while in battle. You also have to hold the potion while you're in battle in order to quaff it.
Actually you don't need to hold anything if you're not tanking. If your group mate gets attacked by a thief, and you immediately engaged BEHIND him, you can still quaff a vial WHILE you're fighting without having to hold it.
But, you DO have to HOLD a vial (or any potion) if you're currently tanking said mob or player.

Are you 100% sure about that? I can say with absolute certainty either way but my gut tells me that you still have to hold it if you are not tanking. Definatly news to me.

Because I did it just recently. (Yesterday in fact).
Side points aside... the original post is spot on - this has been a gribe of mine for ages - I've taken advantage of it of course as a melee - and even as a cleric - but the fact is that nobody should be able to instantly replace sanctuary - without fleeing - if they get dispelled - its just an imbalance against classes with dispel magic. The only other way of doing this is through a staff / stave - which comes with its own downside as you need to hold it - but I'd actually prefer to see that go as well if i'm honest.
I can name several instances, where, if you weren't able to re-cast sanctuary on yourself in combat (for all races, at that) you'd die immediately, and a spell that a certain class has would be an auto-kill button.
It might be a tad imbalanced (maybe lower the duration of sanctuary a little) but it isn't so imbalanced that it needs to be removed.

Just remember, not only melees can use herbs.
The removal of using staves in battle would also require the loss of wands in battle, which removes alot of neat options for low leve RPers, and app characters. There are some very useful orbs/staves/wands out there. Flamestrike and the like.
Overall it is an annoyance, but calling it an imbalance is silly. You think cause I cannot instantly pop it back on with an herb that means I will stay in the fight without it? ERRRRRRR. I will just roll donw the way and prep up again.
If you wanted to take away my ability to do that, then all mages should get hit with free out of combat damage each time they TRY to cast a spell, since I am fairly certain casting a spell requires more concentration than lighting hitting a pipe
